Fees collected in France

The scales of remuneration applicable for each subject medium are set by an independent Commission (art. L 311-5 of the CPI), known as the Private Copy Commission, chaired by a representative of the State, and composed equally by representatives of beneficiaries (authors, performers, producers), and representatives of those liable for remuneration (manufacturers & importers of materials, consumers).

The amounts collected in application of the scales voted by the Private Copying Commission are paid to the beneficiaries in office the type of repertoire copied onto the media concerned (music, audiovisual, text and still images), according to the distribution keys set by law (art. L 311-7 of the CPI). With regard to audiovisual (“private copying of videograms”), 1/3 goes to Authors, 1/3 to Performers, and 1/3 to Producers. Since 1987, the PROCIREP has ensured the repayment of the share due to producers, 25% of the sums collected being devoted to actions to aid creation in application of the legal provisions (art. L.324-17 - formerly L.321-9 - of the CPI).
